Introduction to the Jurisdiction of the Sovran Private Society

The Sovran Private Society operates within a unique jurisdictional framework established on principles of Sovereign Integrity, Common Law, and Indigenous Lawful Traditions. This jurisdiction is distinct from conventional state or corporate legal systems, deriving its authority from the natural rights of its members, spiritual principles, and the foundational laws of the Society’s establishment.

The jurisdiction of the Society is both private and sovereign, designed to uphold the rights and freedoms of its members while ensuring their protections within a decentralized and autonomous legal structure. This framework is recognized under international law and upheld by private contractual agreements among members. Below, we elaborate on the components of this jurisdiction and its implications for members.

Foundation of the Society’s Jurisdiction

1) Sovereign Ecclesiastical Body Politic

The jurisdiction of the Sovran Private Society is rooted in its establishment as a Sovereign Ecclesiastical Body Politic under the auspices of the PanTerraVida Private Society. This ensures that:

  • The Society operates independently of public legal systems, adhering instead to principles of equity, natural law, and the Law of the People.
  • All legal and administrative matters are adjudicated within the jurisdiction of the Sovran Court of the People, in alignment with the foundational principles of the PanTerraVida Court of the People.

2) Recognition of Natural and Indigenous Law

The Society recognizes the inherent rights of all living beings as outlined in natural law and Indigenous lawful traditions. These include:

  • The unalienable rights to life, liberty, property, and the pursuit of peace.
  • The acknowledgment of Turtle Island as the spiritual and ancestral land encompassing the Earth, with Indigenous People as its stewards.
  • The protection of members’ spiritual and sovereign capacities as living beings, free from interference by corporate or state entities.

3) Private Contractual Framework

The Sovran Private Society is governed by private contracts among its members. These agreements:

  • Establish the Society’s jurisdiction as exclusive to its members, independent of state or public interference.
  • Uphold the sanctity of private agreements, which are inviolable and enforceable within the Society’s legal framework.

Implications for Members

  • Miller v. United States, 230 F. 486 (1916): The exercise of a constitutional right cannot be criminalized.
  • Chicago Motor Coach v. Chicago, 169 N.E. 22 (1929): Differentiates rights from privileges; travel is a fundamental right.
  • Gold and Silver as Lawful Money: U.S. Constitution, Art. I, §10—no State shall make any thing but gold and silver coin a tender in payment of debts; aligns with asset-backed monetary principles.
  • Commerce Among Indigenous Peoples: Worcester v. Georgia (1832) and Williams v. Lee (1959) affirm inherent sovereignty and internal trade autonomy; mirrored by the Society’s private transactions among members.
